Terms of Service
These terms govern your use of the website and software provided by Motivasean Coaching LLC ("we", "us"). By using the service you agree to them. If you do not agree, do not use the service.
What the service is
A personal capture and planning tool. You save notes, ideas, and tasks, the software organizes them, and it returns them to you along with a conversational assistant you can talk to about them.
Private beta
The software is currently in private beta and available by invitation only. It is provided free of charge during the beta. Features may change, break, or be removed. We may end the beta or close accounts at any time, and we will give you reasonable notice and the opportunity to export your content before we do.
Your account
You are responsible for keeping your login credentials secure and for activity that happens under your account. Tell us promptly if you believe your account has been accessed by someone else. Accounts are for one person and are not to be shared.
Your content is yours
You keep all rights to what you save in the service. You grant us only the permission needed to store, process, and display it back to you, including processing by the third-party artificial intelligence providers described in our Privacy Policy. We do not sell it, publish it, or use it to train models. You can export it at any time.
Acceptable use
Do not use the service to break the law, infringe anyone's rights, store material you have no right to store, attempt to gain access to other accounts or our systems, or interfere with the service for others.
Text message terms
- By providing your mobile number and agreeing at signup, you consent to receive text messages from Motivasean Coaching LLC related to the service.
- Message frequency varies and is set by you. The default is approximately one message per day.
- Message and data rates may apply.
- Reply STOP at any time to stop receiving messages. Reply HELP for assistance, or email sean@askpurcell.com.
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive text messages is not a condition of using the service.
Availability and no warranty
The service is provided as is and as available, without warranties of any kind, express or implied. We do not warrant that it will be uninterrupted, error free, or that it will preserve or return any particular item. Do not rely on it as the only record of anything critical.
Limitation of liability
To the fullest extent permitted by law, Motivasean Coaching LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities, arising from your use of the service. Our total liability for any claim relating to the service will not exceed one hundred dollars or the amount you paid us in the twelve months before the claim, whichever is greater.
Ending your use
You can stop using the service and ask us to delete your account at any time by emailing sean@askpurcell.com. We may suspend or close an account that violates these terms.
Changes to these terms
We may update these terms. If the changes are material, we will update the date above and notify you. Continuing to use the service after a change means you accept it.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in San Diego County, California.
